These Payment Terms govern pricing, free-trial activation, payment-method verification, recurring billing, cancellation, refunds, payment errors and payment-related customer support for the Quantalis analytical software platform operated by SALAZAR & Co. d.o.o. (the “Company”).
These Payment Terms apply together with the Terms and Conditions of Use, Privacy Policy, Risk Disclosure, Card Tokenization & Recurring Payment Consent, any checkout information displayed before activation, and any Subscription confirmation sent to the User. If mandatory consumer law gives the User greater rights than these Payment Terms, the mandatory law prevails.
Quantalis is a subscription-based digital analytical software service. Users pay only for access to the selected Quantalis product, market, exchange, data source or analytical layer.
The Service does not include brokerage, custody, deposits, withdrawals, trade execution, portfolio management, discretionary account management, personalized investment advice or handling of User funds.
The binding price, currency, billing frequency, applicable taxes, selected product and any promotional conditions are displayed to the User before activation. The price and billing terms accepted during checkout apply to the selected Subscription.
The Company may offer different products or access tiers with different prices or billing periods. No fixed price stated elsewhere overrides the price clearly displayed and accepted by the User for the selected Subscription.
Where VAT, sales tax, use tax or another mandatory tax applies, it will be included or added as required by applicable law and displayed to the User before payment where required.
The standard promotional free trial is seven (7) days unless a different duration is clearly displayed before activation. Unless the Company expressly offers otherwise, each User is entitled to one free trial only across the entire Quantalis platform, for one selected product.
No Subscription fee is charged during the free-trial period. A valid payment method may be required solely for secure verification, tokenization and setup of future recurring billing. The payment provider or card issuer may perform a zero-value verification or another non-settled verification permitted by its technical rules. Any temporary issuer-side display or hold is not a Quantalis Subscription charge.
The free trial begins when the Company confirms activation of access to the selected Service. The trial start, trial end and first billing date are communicated to the User.
Unless the User cancels before the first billing date, the free trial automatically converts into the selected paid recurring Subscription and the price accepted during checkout is charged according to the accepted billing frequency.
A paid Subscription renews automatically at the billing frequency displayed before activation until cancelled. Recurring charges are initiated only after the User has affirmatively authorized the recurring billing arrangement in the payment flow.
Before billing information is confirmed, the User is shown the material Subscription terms, including the price after any free trial, billing frequency, first billing date, automatic-renewal nature of the Subscription and available cancellation method.
Where applicable law imposes additional automatic-renewal or negative-option requirements, including specific disclosures, acknowledgments, reminders, record-retention periods, fee-change notices or cancellation methods, those mandatory requirements apply.
The Company will provide a Subscription or payment confirmation in a form capable of being retained by the User where required by applicable law.
Payment-card data are entered and processed through the secure environment of an authorized payment service provider. SALAZAR & Co. d.o.o. does not store the User’s full payment-card number or CVV on its own systems.
The payment service provider may create a secure token or similar payment-method identifier for future recurring charges. Tokenization and recurring payment authorization are governed by the separate Card Tokenization & Recurring Payment Consent.
The initial card verification or payment may require security measures such as 3D Secure or strong customer authentication where required by the card issuer, payment provider, card scheme or applicable law. Subsequent recurring charges may be processed as recurring or merchant-initiated transactions where lawfully supported.
The User is responsible for maintaining a valid payment method for an active paid Subscription.
If a payment is declined, fails, expires, is reversed or cannot be completed, the Company or its payment service provider may retry the payment where permitted by applicable law and payment rules. Access may be suspended or restricted after any notice required by applicable law until a valid payment method is provided or the payment issue is resolved.
Reasonable additional identity or payment-method verification may be requested where necessary for fraud prevention, payment security or lawful processing.
The User may cancel a Subscription at any time through the cancellation function made available in the User account or through another cancellation method provided by the Company.
Cancellation stops future recurring charges. Unless mandatory law or a more favorable offer provides otherwise, access to a paid Subscription remains available until the end of the current paid billing period.
If the User cancels a free trial before the first billing date, the free trial will not convert into a paid Subscription and no recurring Subscription fee will be charged.
Where applicable law requires online cancellation or cancellation through the same or an equally simple medium as the subscription method, the Company will provide that method.
Ordinary Subscription cancellation and statutory withdrawal are separate rights. Cancellation stops future renewals. A statutory right of withdrawal may apply for a limited period where mandatory consumer law grants such a right.
Where mandatory consumer law grants a statutory right to withdraw from a distance service contract, including the 14-day withdrawal right applicable to qualifying consumers in the European Union and European Economic Area, the Consumer may exercise that right within the applicable statutory period without giving a reason, subject to the conditions and exceptions established by mandatory law.
A Consumer who wants Quantalis access to begin immediately may be asked to make a separate express request for performance of the Service to begin before the statutory withdrawal period expires.
The beginning of the Service during the withdrawal period does not, by itself, automatically eliminate a statutory withdrawal right. If a Consumer validly withdraws after performance has begun at the Consumer’s express request, the Consumer may be required to pay an amount proportionate to the Service provided up to the time of withdrawal, but only to the extent permitted by mandatory law and only where the required information and consent requirements have been satisfied.
Where applicable law requires an online withdrawal function, the Company will make it easily accessible during the statutory withdrawal period and will provide the legally required acknowledgment of a submitted withdrawal request on a durable medium.
Following a valid statutory withdrawal, future recurring charges will be stopped and any refund or permitted proportionate charge will be handled in accordance with mandatory law. Where no payment has been charged during a free trial, there may be no amount to refund.
Except where these Payment Terms, a specific offer or mandatory law provides otherwise, amounts validly charged for a current Subscription period are non-refundable after that period begins. This does not limit any non-waivable consumer remedy.
Users should promptly report duplicate charges, payment errors, cancellation issues or other billing problems to the Company so that the matter can be investigated.
A lawful chargeback or other payment-dispute right is not waived by these Payment Terms. During a payment dispute, the Company may review or temporarily restrict the affected Subscription where reasonably necessary to protect the account or prevent misuse, without limiting mandatory consumer rights.
Written payment complaints may be submitted using the contact details below. The Company will respond within the mandatory period prescribed by applicable law.
The Company may change prices, Subscription conditions or billing arrangements for future periods. A change affecting an active Subscription will be communicated in advance where required by applicable law, together with cancellation information where required.
Where affirmative consent is legally required for a material billing change, continued use alone will not replace that consent.
Nothing in these Payment Terms excludes, limits or waives a Consumer right or remedy that cannot lawfully be excluded, limited or waived. Where mandatory law in the Consumer’s country, state or place of habitual residence provides greater protection, that law prevails to the extent of the conflict.
